Terms of Service

Welcome to Refetch(er). These Terms of Service ("Terms") govern your access to and use of the Refetch(er) developer API service, website, and related control plane panels ("Service"), provided by Refetch(er) ("we", "us", or "our").

By creating an account, generating an API key, or otherwise using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. API License & Service Scope

Subject to your full compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and query the Refetch(er) scraper API solely to retrieve public, unmodified post metrics for your applications.

The Service retrieves data in real-time from publicly available web sources. You acknowledge that we do not own, host, or control the social media platforms (Instagram, TikTok, YouTube, X, Facebook) from which public data is scraped, and that the layout and availability of such data are subject to change at any time without notice.

Third-Party Compliance: You acknowledge that web scraping may violate the terms of service of third-party platforms. You are solely responsible for ensuring your use of this API complies with the laws and terms of the platforms you target. Refetch(er) assumes no liability for your compliance with third-party rules.

3. User Restrictions

You agree that you will not, and will not permit any third party to:

  • Use the API to scrape, access, or extract non-public, private, or restricted social media contents (such as posts from private accounts or direct messages).
  • Query the Service in any manner that executes denial-of-service (DoS) attacks, attempts to overload our dispatcher system, or otherwise degrades Service performance for other customers.
  • Bypass, disable, or circumvent any security-related features, authentication hashes, or usage boundaries enforced on your API keys or control panel dashboard.
  • Use the Service to build a competing real-time social media scraping API product or database mirror.
  • Incorporate the Service into any applications that facilitate harassment, spam, copyright infringement, or illegal surveillance.
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of the Service or its scraping dispatchers.
Compliance Violation: We reserve the right to immediately suspend or permanently revoke your API keys and dashboard access without warning or refund if we detect usage violating these restrictions.

4. Billing, Balance & Expiry

Refetch(er) operates on a strictly pay-as-you-go credit structure:

  • Prepaid Balance: You must purchase credit via prepaid top-ups on your dashboard. All charges are deducted dynamically at request execution time.
  • Successful Scrapes Only: You are only debited for successful scrapes. A successful scrape is strictly defined as any request that returns an HTTP status code between 200 and 299 from our API, indicating the upstream target was successfully reached and processed, regardless of whether the target post contained the specific data points you expected. If a scrape returns a final error category (e.g. rate limit, invalid URL, or server timeout), the transaction is marked free and does not debit your balance.
  • No Expiry: Prepaid credit balance never expires. It remains active on your account until spent, regardless of activity intervals.
  • Bonus Credit Tiers: Qualifying top-ups receive bonus credit (e.g., +5% bonus at $200+, +10% bonus at $500+). Bonus credits are subject to the same terms and are non-transferable and non-refundable.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. REFETCHER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BECAUSE SCRAPING RELIES UPON PUBLIC PLATFORMS THAT WE DO NOT CONTROL, WE DO NOT WARRANT THAT: (A) THE DATA RETRIEVED IS 100% ACCURATE, COMPLETE, OR UP-TO-DATE; (B) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ACCESSIBLE AT ANY SPECIFIC TIME; OR (C) UPSTREAM NETWORK LAYOUT CHANGES BY SOCIAL PLATFORMS WILL NOT TEMPORARILY AFFECT SCRAPING RELIABILITY.

6. Limitation of Liability & Indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL REFETCHER, ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS OF ANY KIND ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE API SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO REFETCHER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Refetch(er) and its affiliates from and against any third-party claims, damages, losses, or legal liabilities arising from your integration of the API or your violation of these Terms.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Delaware before one arbitrator.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated or resolved on a class action-basis or to utilize class action procedures.
